Item The medico-legal principle of confidentiality in doctor-patient relationships in Nigeria(2018) Ibitoye, T. R.The bedrock of a doctor-patient relationship is confidentiality, and every person has the right to keep his/her personal information private and confidential from the public. The effect of confidentiality on patients is that it helps patients seeking medical advice to be open with their doctors and trust same that the latter would keep such information secret and will not disclose such to others. However, the duty of confidentiality is not absolute. It can be disclosed where a patient gives his/her consent; or as required by the court of law, statutes; or public interest. Hence, this paper shall define the related concepts of privacy and confidentiality; examine the statutory framework of confidentiality in Nigeria; discuss the principles of confidentiality; instances when confidentiality can be disclosed/waived; and conclude by submitting recommendations on how confidentiality in a doctor-patient relationship can be effectively maintained in Nigeria.Item Who is the victim? O.Medical error is an adverse event that could be prevented, given the current state of medical knowledge. It has been defined as the failure of a planned action to be completed as intended or the use of a wrong plan to achieve an aim. Medical errors can occur in any health care setting in the form of an ‘adverse drug event, improper transfusion, surgical injuries and wrong site injuries, suicide, restraint-related injury or death, falls, burn, pressure ulcers and mistaken patient identity, When errors occur, ethics, professional policy and the law suggest that timely and candid disclosure be the standard practice. Disclosure however raises a number of ethical, legal, and psychological issues which will be discussed in this study. The study further examines the philosophical basis for disclosure and non-disclosure; the duty owed by the physician to the patient; the effect of disclosure on patients and physicians. In discussing the effect of medical error on patients and physicians, the benefit and harm of disclosure and its effect on patient/physician relationship will be examined
